General Terms and Conditions (GTC)

§ 1 Provider
The contractual partner for yoga classes for all yoga offers is:

§ 2 Scope of Application
These General Terms and Conditions (GTC) apply to all contracts between Jasmin Hauke and her participants for all yoga offers from JASE Yoga, unless otherwise agreed in individual cases.
§ 3 Registration; Conclusion of Contract
(1) Contracts between Jasmin Hauke and her participant are concluded by offer and acceptance in the sense of §§ 145 BGB ff.
(2) General information about class times, course offerings etc. on Jasmin Hauke's website ("Jase Yoga") does not constitute a binding offer to conclude a contract, but merely an invitation to submit an offer ("invitatio ad offerendum").
(3) Registration for Yin Yoga sessions can be done via email or WhatsApp. The registration is binding upon receipt by Jasmin Hauke (acting under "Jase Yoga") and cannot be unilaterally withdrawn.
(4) A contract for participation in Yin Yoga sessions is only concluded upon acceptance of the registration by Jasmin Hauke. Acceptance is made via email or WhatsApp.
§ 4 Class Times
Yin Yoga sessions take place on different days, which are noted on Jasmin Hauke's website ("Jase Yoga") under "Yoga" and are regularly updated. Due to holidays, there may be changes to class times, which will also be noted on the website under "Yoga". In case of illness of the teacher, substitute dates for cancelled Yin Yoga sessions will be arranged by mutual agreement.
§ 5 Payment
(1) Course fees must be received in Jasmin Hauke's account no later than one day before the start of the Yin Yoga sessions or on the same day as the Yin session at the latest.

(2) Alternatively, by prior arrangement, the amount can also be paid in cash on the day of the course.
§ 6 Prevention of Course Participants; Processing Fee
(1) Should a course participant be unable to attend a yoga class for personal reasons, there is no entitlement to a refund. However, cancellation of Yin Yoga sessions is possible free of charge up to 48 hours before the start of the course if done in text form via email or WhatsApp. If the cancellation occurs outside this period, there is no entitlement to a refund. However, an alternative date can be arranged by mutual agreement.
(2) If the cancellation occurs less than 48 hours before the start of the course without a verifiable important reason and the course participant takes advantage of an alternative date, a flat processing fee of €15.00 per case will be charged – after a single goodwill cost-free instance – starting from the second late cancellation.
(3) The arrangement of an alternative date without new course fees only possible within 2 weeks of the missed appointment, provided that a binding registration for a specific substitute appointment is made.
§ 7 Exclusion of the Statutory Right of Withdrawal
The statutory right of withdrawal, which generally applies to contracts concluded off-premises and distance contracts according to § 312b paragraph 1 BGB, does not apply here according to § 312b paragraph 2 No. 9 BGB, as these are services related to leisure activities and a specific date or period is provided for their provision.
§ 8 Liability
(1) Jasmin Hauke is liable without limitation for claims arising from intent and gross negligence.
(2) Otherwise, Jasmin Hauke is liable for the slightly negligent breach of essential contractual obligations ("cardinal obligations") only for foreseeable, typical damage.
(3) Jasmin Hauke is not liable for the breach of other obligations in cases of slight negligence.
(4) The limitations of liability do not apply to claims arising from injury to life, body, and health, as well as claims from product liability.
(5) The limitations of liability apply accordingly to representatives and vicarious agents.
(6) Notes on physical and mental condition:
- Participation is at one's own risk. Medical advice is recommended.
- Yoga classes are not a substitute for therapy.
- Existing ailments or pregnancy must be communicated in advance.
§ 9 Copyright; Rights of Use; Right to One's Own Image
(1) The copyright of all teaching materials belongs to Jasmin Hauke. Reproduction or dissemination requires written permission.
(2) Photo or video recordings may be used in print and online media for course presentation purposes. Further publication will only be made with separate consent.
§ 10 Data Protection
(1) Personal data will be processed as far as this is necessary for contract execution.
(2) Further information can be found in the website's privacy policy.
§ 11 Applicable Law
German law applies.
§ 12 Severability Clause
Should individual provisions of these GTC be or become ineffective, the validity of the remaining provisions remains unaffected. In place of the ineffective provision, the statutory provisions shall apply.
